GENERAL SALES CONDITIONS
The website "http://www.agrimar.it" is owned by Azienda Agr. Mariucci, legal head office in via di Vallelunga, 31 – 00068 Rignano Flaminio (RM)
General Sales conditions furnished by Agri.Mar. and indicated in the present web-site, will be valid if Agri.Mar will not apport changes or integrations. The last updated version is the one indicated in the web-site. Any changes or integrations will be valid since they will be published in the web-site
Contract (in this case “distant contract” as per art. 50 Consumers' Code) between Agri.Mar and the Client has to be intended conclused with the acceptance, also partial, from Agri.Mar. of a purchase proposal on web-site www.agrimar.it
Placing an order, Clients declares: 1) to be a Consumer, as per art. 3 Consumers' Code; 2) to be an adult; 3) to provide the correct information; 4) to have read all indications given during the purchase order and to accept General Conditions and payment terms, indicated in the website.
DRAFT OF THE CONTRACT. If Client is a physical person, acquiring goods for non commercial purpose, once concluded online purchase, he will provide to keep the present Sales General Conditions, as per art. 3 and 4 D. lgs. 185/1999, printing or saving a copy of the present contract
EXCLUSION OF RESPONSIBILITY TERMS. In case of non acceptance, also partial, of an order by Agri.Mar, it is excluded any rights for reimbursement, contractual or extra contractual responsibility for direct or indirect damages to people or things
DISCLAIMER. Indications on products, given by Agri.Mar., have to be intended as simple informative material and they are not intended to be a substitute for professional medical advice. Agr.Mar. suggests to read ingredients, INCI composition, use mode on the products before using them
Client is safeguarded only for purchase of products indicated in Agri.Mar electronic catalogue. Images used in the product descrption could be different from dimensions, colors or other details of the real product.
NON-ACCEPTANCE OF ORDER. Agri.Mar will communicate immediately to the client all non-accepted orders.
INVOICE. Agri.Mar. will issue invoice for any received order only on direct Client's request. Request has to be made during the order, indicating Vat code. Invoice will be sent by e-mail. Agri.Mar will use information given by the Client. After issuing no change will be admitted.
Client can choose one of the following payment terms: Paypal, cash on delivery or payment in advance by bank transfer.
PAYPAL. In case of payment by Paypal, Paypal will charge immediately total purchase amount. If order will be cancelled by the Client or if Agri.Mar will not accept it, total amount of the cancelled order will be accredited on Client's Paypal account. In this case time for transfer on Client's account depends on Paypal. After the amount will be accredited on Client's account, Agri.Mar could not be considered responsible for any damages (delay in the transfer).
Agri.Mar. reserves the right to request additional information (as telephone number) in order to verify the right ownership of Paypal account. Agri.Mar reserves the right of non-acceptance of the order if the information is not correct.
Agri.Mar could not know information about Client's credit card or other methods choosen in Paypal wallet.
CASH ON DELIVERY (C.O.D). For this payment method it is required an addition amount to pay at courier as additional expences. It is necessary to indicate a telephone number that courier could use for the delivery. In this case requested invoice will be issued only after Agri.Mar will have received the total amount of the order.
In case of non acceptance of the order, Agri.Mar. reserves the right to request to the Client delivery expenses and cost for eventual damages of the products.
Payment in advance by bank transfer. In this case Client will receive all instructions in the last phase of Checkout. We suggest to anticipate by mail (to firstname.lastname@example.org) or by fax (n. 06/99335411), a copy of the payment, in order to proceed with the order realization.
Order will be sent only once payment will be received.
- Orders will be automatically cancelled if payment will not received in 5 working days from
the order date
- Requested invoice will be issued only after receiving in the account the owed amount
SHIPMENT AND SHIPMENT COSTS
Agri.Mar. accepts orders according stock. So delivery of the order is defined according stock of the products. Agri.Mar will communicate to the Client eventual sold out. In particular situations or in order to grant the service efficiency, Agri.Mar could use a courier, different from the one choosen by the Client.
-Products will be delivered to the address indicated by the Client as per carrier timing and before 30 days from the end of the contract. Agri.Mar Company cannot be held responsible and shall remain exempt from all liability for physical damage to a shipment, or loss caused by delay of delivery, when conditions beyond the carrier’s control are encountered during transit.
Shipment costs are charged to the Client and indicated during order placement, except particular promotions, specifically indicated, charged to Agri.Mar. These promotions will be indicated on the website. Payment will be made by the Client using the terms indicated at the order. Except the order nothing else is owed to the Client.
Delivery is intended on the first floor, except for particular situations if indicated.
During delivery Client has to check that package is safe and not damaged.
Attention: Any damages to the shipment spotted by the customer must be reported at the moment of the delivery by filling a damage report with the driver or by signing with reservation the proof of delivery. Otherwise, the selected courier company or the insurance company may reject any claim for damages.
Eventual problems should be communicated before 7 days after the delivery.
NON-ACCEPTANCE OF GOODS
In case of non-acceptance of goods after 5 days in our courier's stores, order will come back to Agri.Mar. For a new order, it will be necessary to define new agreements and additional cost for delivery.
RIGHT OF WITHDRAWAL
Under Art. 5 of the Legislative Decree n. 185/1999, if the Customer is a consumer (a natural person purchasing the goods without job-related purposes or without specifying in the order form a VAT No. reference), he/she is entitled to exercise the right of withdrawal from the purchase contract for any reason, without giving any explanation and without any penalty, except for what is stated in the following paragraphs.
-the right shall apply only for the entire purchased product; it is not possible to return only a part of the purchased product (accessories, software, etc...);
-The right is likewise understood to exclude purchases that are not covered under "distance sales" and products that have been modified or customized on request.
-the purchased product shall be returned undamaged and in its original package, complete with all its parts (including packaging, documentation and any other accessory: manuals, cables, etc...);
-in accordance with the law, transport for the return of the goods shall be paid by the customer; the customer will not be refunded for delivery charges and other additional costs established at the moment of the order;
-until confirmation of their receipt by the company's warehouse, the goods are shipped under the entire responsibility of the Customer;
-if the goods are damaged during transport the company shall notify the Customer thereof (within 5 working days from receipt of the goods at its warehouses) so as to permit the Customer to promptly give notice to the his/her carrier and obtain refund of the value of the goods (if insured). In this case the goods will be made available to the Customer for return and the request of withdrawal will be cancelled;
-Agri.Mar. shall in no way be held liable for damages or theft/loss of goods returned by uninsured shipment;
-upon arrival to the company's warehouse, goods will be examined to assess damages or tampering not deriving from transport. If the original packaging is damaged, Agri.Mar. shall deduct a percentage from the refund (in any case max. 10% of the refund value) as compensation to cover incurred costs.
The Customer can exercise his/her right of withdrawal by sending an appropriate notice within 10 working days from date of delivery of the goods. The notice shall be sent by registered letter with acknowledgement of receipt to:

or by telegram/fax sent within 10 days and confirmed by registered letter with acknowledgement of receipt PEREMPTORILY within the following 48 hours. Once the company has received the notice of withdrawal, the Customer Service will promptly contact the customer to give him/her all the necessary instructions and assign a RMA code to return the goods. The goods must be returned to Agri.Mar. within 10 days from the return authorization. The goods must be returned undamaged, complete with all their parts and original package (envelopes and boxes), stored and (in case) used with normal diligence, without any evident sign of wear or dirt, respecting the following conditions.
Except for the compensation to restore the damaged original packaging, Agri.Mar shall refund the customer the entire amount paid within 14 days from return of the goods by a coupon (with the same amount, additional expenses excluded) to use on our shop online Agrimar.it
FORFEITURE OF RIGHT OF WITHDRAWAL
The right of withdrawal is entirely forfeited if the essential condition of product integrity (package and/or content) is not met, that is when Agri.Mar. ascertains:
ñimproper use of the goods compromising their integrity or use of any consumable material;
ñlack of the original external and/or internal packaging;
ñlack of integral parts of the goods (accessories, cables, manuals, parts, ...);
ñdamage to the goods due to reasons other than transport.
If the right of withdrawal is forfeited, the goods will remain at the warehouses of Agri.Mar. and made available for collection at the customer's expenses.
Agri.Mar. will not be liable for any failure or delay in the delivery of the Event which is caused by circumstances beyond its reasonable control.
In case that the Client has any complaints regarding Agri.Mar's services, the Client will have to begin a complaints procedure.
In order for the internal complaints procedure to begin, the Client should inform Agri.Mar in writing by sending an registered letter to Az. Agr Mariucci, via di Vallelunga 31, 00068 Rignano Flaminio (RM).
APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of Italy and will be interpreted in accordance with the Italian laws.
The Rome courts shall have exclusive jurisdiction to settle any claim or dispute which might arise out of or in connection with these terms and conditions.
